1. Conditions for returns

- Personally made or custom-designed products cannot be returned or exchanged.
- This includes, among other things, products made to individual measurements or with personal design, logos, sponsors, name, initials, special colour combinations, or other individual customisations.
- The right to return standard items does not affect the customer’s statutory rights.
2. How to return
- Standard items can be returned within 30 days of receipt.
- Contact AP Hjelm Design before returning the item so you can receive the necessary return information and any return label.
- If we have provided a specific return label, it must be used.
- The item must be packed securely so it is not damaged during return shipping.
3. Return costs
For standard returns, the customer may be charged the cost of return shipping. The amount depends on the country, parcel size, and carrier.
If the return is due to a valid complaint, the rules in the section on complaints apply.
4. Refund
Once we have received and inspected the returned item, the refund will be processed.
As a rule, the refund is made to the same payment method used for the purchase.
It may take up to 14 business days for the refund to be fully processed and visible in the customer’s account, depending on the payment provider.

General terms and conditions of trade
1. Introduction
1.1
These terms and conditions of trade (“the Terms”) apply to the use of AP Hjelm Design’s webshop and the purchase of products from AP Hjelm Design ApS.
1.2
By making a purchase, the customer accepts the terms and conditions in force at the time of the order.
1.3
You must be at least 18 years old to make a purchase. If you are under 18, consent from a parent or guardian is required.
1.4
AP Hjelm Design may change the terms and conditions on an ongoing basis. The terms and conditions in force at the time of the customer’s order apply to that order.
2. Orders & prices
2.1
When you place an order with AP Hjelm Design, you are ordering the products and any individual customisations stated in the order.
2.2
After ordering, the customer receives an order confirmation or other confirmation with information about the order.
AP Hjelm Design reserves the right to reject an order, for example in the event of obvious pricing errors, technical errors, non-payment, or if a product cannot be delivered.
2.3
Prices may change without prior notice. A price change does not affect orders already accepted and paid for, unless there is an obvious pricing or system error.
If a significant pricing error is identified, we will contact the customer before the order is processed further.
2.4
Payment must be made via the payment methods offered on the webshop or by separate agreement with AP Hjelm Design.
2.5.
Gift cards can be purchased directly on the webshop and can be used to pay for goods.
Gift cards are valid for 1 year from the date of issue and cannot be exchanged for cash.
2.5 Customs, VAT and import duties
For sales to countries outside the EU, the customer may be charged local customs, VAT, import, or administration fees.
Unless otherwise expressly stated at the time of ordering, the customer is responsible for any local import duties, customs, and taxes in the destination country.
2.6 Custom-designed and personalised products
A large part of AP Hjelm Design’s products are made individually to the customer’s wishes.
This may include, for example:
- Custom-designed helmets
- Personally designed driving suits
- Jackets and trousers
- Driver Shirts
- Team and stablewear
- Products made to individual body measurements
- Products with logos, sponsors, names or initials
- Products made in the customer’s individual colours and design
Once production of a custom-designed or personalised product has begun, the order generally cannot be cancelled.
Products made to the customer’s specifications or given a clear personal touch are not covered by the standard right of withdrawal to the extent permitted by law.
3. Design, customer approval and final acceptance
3.1 Design sketch and visualisation
For custom-designed products, AP Hjelm Design may prepare a digital design sketch or visualisation, which the customer will have the opportunity to review and approve before production.
The submitted sketch is an indicative visualisation and cannot be regarded as a 1:1 representation of the finished product.
The purpose of the sketch is to show the design concept, the colours, and the overall visual expression.
When the customer approves the sketch, the customer therefore approves the design concept and the overall visual expression – not an exact 1:1 reproduction of the sketch’s proportions, sizes, and placements on the finished product.
3.2 Differences between sketch and finished product
Design sketches and digital visualisations cannot fully reproduce the physical product.
Especially for helmet design, the digital sketch is a flat, two-dimensional visualisation, while the finished helmet has a three-dimensional, curved shape. The helmet’s actual proportions, curves, shape, and size may therefore naturally result in differences between the sketch and the finished result.
The design’s lines, panels, logos, patterns, and other elements may therefore appear different in size, proportions, angles, and placement on the finished helmet than on the digital sketch.
Differences may occur, among other things, due to:
-
The helmet’s three-dimensional shape, curves, and proportions
-
The difference between a flat 2D sketch and a physical 3D helmet
-
Different helmet models and helmet size proportions
-
Necessary adjustments to the design’s lines, panels, and shapes
-
Adjusting the size and placement of logos, names, and graphic elements
-
The structure and properties of the product and materials
-
Stitching, joins, and edges
-
Sublimation and other printing methods
-
Hand lacquering and airbrush
-
Metallic, glitter, and reflective effects
-
Lighting conditions and screen colour rendering
-
Production methods and necessary production-related adjustments
During production, AP Hjelm Design may make reasonable and necessary adjustments to, among other things, placement, size, proportions, angles, line flow, and details so the design works as well as possible on the specific helmet or product.
Such natural and production-related differences between the sketch and the finished product are not in themselves considered a fault or defect.
3.3 The customer’s responsibility to check
Before the customer approves the design, it is the customer’s responsibility to thoroughly check that the design concept and overall visual expression meet the customer’s wishes.
This includes, among other things:
-
Design and design lines
-
Colours and colour combinations
-
Names and initials
-
Logos and sponsor logos
-
Texts and spelling
-
The overall placement of graphic elements
-
The overall visual expression
If the customer wants changes, these must be communicated before final approval.
3.4 The customer’s approval is final
When the customer approves the design sketch in writing or digitally, the design concept and overall visual expression are considered finally approved, and AP Hjelm Design may then begin production.
The customer’s approval also implies acceptance that the finished product will not necessarily be an exact 1:1 reproduction of the digital sketch.
After approval, the customer therefore cannot subsequently claim, for example, that the customer:
-
No longer likes the approved design
-
Had imagined the finished result differently
-
Wants different colours or colour combinations
-
Wants a different design or visual expression
-
Wants logos, lines, names, or other elements placed differently
-
Expected the sketch’s proportions and placements to be transferred exactly 1:1 to the physical product
Subjective dissatisfaction with a design concept and visual expression that the customer has approved is not in itself considered a fault or defect and does not in itself entitle the customer to replacement, a price reduction, return, or refund.
This does not limit the customer’s statutory rights if the product has an actual fault or defect.
3.5 Changes after approval
Once the design has been approved, production can begin immediately.
Changes after approval therefore cannot be guaranteed.
If a change is still possible, AP Hjelm Design may charge for additional design work, materials, and production already carried out.
If production has progressed to the point where changes are no longer possible, the product will be completed based on the approved design concept.
3.6 The customer’s materials and rights
The customer is responsible for having the necessary rights and permissions for logos, trademarks, images, sponsor logos, texts, and other material the customer wishes to be used on the product.
By approving the design, the customer also confirms that the material the customer has provided or asked AP Hjelm Design to use may be used to manufacture the product.
3.7. Design on the customer’s existing helmet
If a personalised design and lacquering is desired on an existing helmet, the price is DKK 3,650 excl. VAT.
The price includes design and lacquering according to the agreed and approved design. When the customer has approved the submitted design, the design is considered finally and bindingly approved. Preclusion then applies preclusion, which means that the customer cannot subsequently request further changes to the approved design.
This includes, among other things, changes to colours, colour codes, logos, sponsor logos, names, initials, fonts, patterns, pinstriping, and placements.
It is the customer’s responsibility to check all details thoroughly before final approval.
4. Individual measurements
4.1
For products made to individual measurements, the customer is responsible for ensuring that the measurements provided are correct.
4.2
The customer must follow AP Hjelm Design’s measuring guide and instructions as accurately as possible.
4.3
If a product does not fit due to incorrect or imprecise measurements provided by the customer, this is generally not considered a production error.
If, on the other hand, the product deviates significantly from the agreed measurements due to a production error, the matter will be handled as a complaint.
5. Delivery
5.1
We strive to deliver all orders as quickly as possible.
Custom-designed products require production time, and the expected delivery time is stated on the webshop, in the order confirmation, or in connection with the order.
5.2
Delivery times for custom-designed products are indicative unless a specific delivery date has been expressly agreed.
Production time may vary depending on the product, design, individual measurements, materials, and order volume.
5.3
Delays may occur due to circumstances beyond AP Hjelm Design’s reasonable control, for example transport issues, customs processing, supplier delays, or other extraordinary circumstances.
The customer’s statutory rights in the event of a significant delay are not affected by this provision.
5.4
If the customer has provided incorrect or incomplete delivery information, any additional shipping, return, customs, or administration costs may be charged to the customer.
5.5
If the customer refuses to accept a correctly delivered order, the actual costs associated with return transport and any customs or import costs may be deducted from a refund where permitted under applicable law.
Custom-made and personally designed products cannot be returned solely on the grounds that the customer no longer wants the item.
6. Payment methods
AP Hjelm Design accepts the payment methods that at any time appear on the webshop.
Payment is processed via the relevant payment provider.
If payment is declined or not approved by the customer’s bank, card issuer, or payment provider, AP Hjelm Design is not responsible for delays caused by the missing payment.
7. Right of withdrawal and returns
7.1 Standard products
For standard products, the statutory right of withdrawal applies, as well as any additional return rights offered by AP Hjelm Design.
If AP Hjelm Design offers a 30-day return right on standard items, this applies from the day the customer receives the item.
7.2 Custom-designed products
Products made to the customer’s specifications or given a clear personal touch generally cannot be returned or exchanged.
This includes, among other things, products with:
- Personalised design
- Individual measurements
- Name or initials
- Logos or sponsor logos
- Customer-specific colours
- Individual lacquering
- Special-ordered details or combinations
The lack of a right of withdrawal for personalised products does not limit the customer’s right to complain if the product has a fault or defect.
8. Complaints
8.1
If the customer discovers a fault or defect in a product, AP Hjelm Design must be contacted within a reasonable time after the fault is discovered.
8.2
In the event of a complaint, the customer is asked to provide:
- Name
- Email address
- Order number
- Purchase date
- Description of the problem
- Relevant photos or other documentation
8.3
AP Hjelm Design assesses the complaint in accordance with applicable consumer protection legislation.
8.4
In the event of a valid complaint, the solution may, depending on the circumstances, be:
- Repair
- Rectification of the fault
- Replacement
- Proportionate reduction
- Refund
This is done in accordance with applicable law.
8.5
If the item must be returned as part of an approved complaint, the return will be agreed with AP Hjelm Design.
8.6
Normal wear and tear, incorrect use, lack of maintenance, damage caused by accidents, or use contrary to the product’s intended purpose are not considered production errors.
8.7
For consumer purchases, the statutory right to complain under Danish law applies.
9. Colours, materials and product appearance
9.1
We strive to reproduce colours and designs as accurately as possible.
However, colours may appear differently depending on the screen, lighting conditions, material, print, lacquering, and production method.
9.2
Metallic, glitter, reflective materials, and special effects may appear different physically than on a digital design sketch or computer screen.
Minor visual differences that are natural to the material or production method are not necessarily considered a defect.
10. Liability
10.1
Nothing in these terms and conditions limits AP Hjelm Design’s liability in cases where such limitation is not permitted under applicable law.
10.2
AP Hjelm Design is not liable for indirect loss, operating loss, loss of profit, or other business consequential losses to the extent such limitation is legally permitted.
10.3
AP Hjelm Design cannot be held liable for non-performance or delayed performance due to extraordinary circumstances beyond our reasonable control.
This may include, among other things, natural disasters, fire, flooding, war, strikes, major transport disruptions, government intervention, pandemics, or similar extraordinary events.
10.4
Nothing in these terms limits the mandatory rights a consumer has under applicable law.
11. Choice of law and disputes
11.1
The terms and conditions of trade are governed by Danish law.
This does not limit any mandatory consumer rights the customer may have under the legislation of their country of residence.
11.2
Any disputes will initially be sought resolved between the customer and AP Hjelm Design.
If this is not possible, the matter may be handled by relevant complaints bodies or courts in accordance with applicable law.
12. Intellectual property rights
12.1
AP Hjelm Design’s website, product images, texts, graphic elements, design material, and other original content belong to AP Hjelm Design or our respective licensors, unless otherwise stated.
12.2
The material may not be copied, reproduced, distributed, or used commercially without prior written permission from AP Hjelm Design, unless otherwise provided by applicable law.
12.3 Customer designs and logos
Logos, trademarks, and other material provided by the customer remain the property of the customer or the respective rights holder.
The customer grants AP Hjelm Design the right to use the material to the extent necessary to design and produce the ordered item.
13. Company information
